These terms of sale govern the Firmavio subscription, reserved for business customers. All prices are exclusive of VAT.

These terms of sale define the conditions under which TropicaThai LLC, a US company (Wyoming) operating under the Firmavio name, provides a subscription service covering the creation, hosting and maintenance of a website.
Placing an order implies full acceptance of these terms, which prevail over any other document.
The Firmavio offer is strictly reserved for professionals acting for the purposes of their business (B2B). It is not open to consumers.
Ordering requires a valid SIREN number and a declaration of professional use. Firmavio reserves the right to refuse any order that does not meet these conditions.
The subscription costs €24.99 excl. VAT per month, or €239.88 excl. VAT per year paid upfront — the equivalent of €19.99 excl. VAT per month, with the CDN included for free. Website creation is free: no setup fees, no hidden fees. An optional booking module is available for +€5 excl. VAT per month.
All prices are exclusive of VAT. For business customers established in France with a valid intra-Community VAT number, VAT is accounted for by the customer under the reverse-charge mechanism (art. 283-2 of the French Tax Code; art. 196 of Directive 2006/112/EC); the corresponding statement appears on the invoice.
If the price list changes, existing customers keep the rate in force at the time they subscribed.
The customer is entitled to a full refund, no questions asked, upon simple request made within 14 days of the first payment.
The refund results in the immediate cancellation of the subscription and the site being taken offline.
The subscription, monthly or yearly, is commitment-free and renews automatically at each term. The customer may cancel at any time: cancellation stops the renewal and the site stays live until the end of the period already paid.
Cancellation does not give rise to any refund for the current period, except under the guarantee set out in article 4.
For the yearly plan, a renewal notice is sent to the customer by email between 3 months and 1 month before the renewal date.
The customer remains the owner of their domain name where they provided it, as well as of all content they supplied (text, images, logo).
Upon cancellation, Firmavio provides the customer with an export of their content. The technical platform, templates and code developed by Firmavio remain the property of TropicaThai LLC.
The customer agrees to provide accurate, up-to-date information (identity, SIREN, contact details, payment method) and to report any change.
The customer warrants that they hold the rights to all content they submit and remains solely responsible for its lawfulness and for the mandatory notices specific to their activity.
The customer shall not use the service in any way contrary to the law or to third-party rights.
Firmavio is bound by a best-efforts obligation. We do everything we can to keep the site available, but cannot guarantee uninterrupted service (maintenance, outages, force majeure).
TropicaThai LLC's liability is limited to direct damages and cannot exceed the amounts paid by the customer over the last twelve months. It does not extend to content supplied by the customer, nor to indirect damages (loss of business, revenue or data).
Personal data is processed in accordance with our privacy policy, which details the processing carried out, retention periods and your rights (GDPR). For the data of visitors to the customer's site, TropicaThai LLC acts as a processor.

In the event of a dispute, the parties will first seek an amicable solution. Failing agreement, the dispute will be brought before the competent courts.
